This Party Bus Rental Agreement and Liability Waiver (“Agreement”) is entered into between Alpha Express Transport LLC (“Company”) and the undersigned client (“Client”) for the rental and use of the Company’s transportation vehicle (“Bus”). By signing this Agreement, Client acknowledges and agrees to the terms and conditions set forth below.
1.0 Reservation and Payment Terms
1.1 Reservation Deposit:
A minimum of $500 deposit is required at the time of booking to reserve the bus for the requested date and time.
1.2 Refundable Damage Deposit:
A refundable $350 damage deposit is required. This deposit covers potential cleaning, minor repairs, or restoration costs resulting from the rental.
Please note that the $350 deposit is only refundable if no damages occur and cleaning is limited to standard upkeep (i.e., sweeping, mopping, and wiping down surfaces). If excessive cleaning, repair, or replacement of property is needed, the deposit will be retained in part or in full at the discretion of the Company.
1.3 Final Payment:
The remaining balance of the total rental amount must be paid in full prior to boarding. No passenger will be permitted to board the bus until full payment is received.
1.4 Payment Methods:
Payments may be made by cash, credit card, or another method approved by the Company.
2.0 Conduct and Behavior
2.1 Respectful Conduct:
All passengers are expected to conduct themselves respectfully toward the driver and staff. The Company reserves the right to immediately remove or refuse service to any individual who:
- Is disrespectful, abusive, or threatening toward the driver or staff;
- Engages in illegal activity;
- Causes damage to the vehicle; or
- Creates an unsafe environment for others.
2.2 Termination Without Refund:
If service is terminated due to misconduct or policy violations, no refund or credit will be issued.
2.3 Responsibility for Damages:
The Client is fully responsible for any damages to the bus caused by themselves or their guests. Any repair costs exceeding the deposit amount will be charged to the Client.
3.0 Cancellations and Refund Policy
3.1 Cancellation Window:
Cancellations must be made no later than 48 hours prior to the scheduled trip in order to receive a refund of the $500 reservation deposit.
3.2 Late Cancellations:
If a cancellation occurs within 48 hours of the scheduled trip, the Client forfeits the $500 reservation deposit in full.
3.3 Damage Deposit:
The $350 damage deposit remains non-refundable under circumstances of damage or heavy cleaning that goes beyond upkeep.
3.4 No-Show Policy:
Failure to appear at the scheduled pickup time without prior notice will result in forfeiture of all payments made.
4.0 Liability and Waiver of Claims
4.1 Assumption of Risk:
Client and all passengers acknowledge that riding in a party bus involves certain risks, including but not limited to injury, falls, sudden stops, or passenger behavior. By participating, all passengers voluntarily assume these risks.
4.2 Limitation of Liability:
Alpha Express Transport LLC, its owners, employees, and affiliates are not liable for:
- Injuries, losses, or damages sustained by any passenger;
- Lost, stolen, or damaged personal items;
- Delays, cancellations, or interruptions caused by traffic, weather, or events beyond the Company’s control.
4.3 Indemnification:
The Client agrees to indemnify, defend, and hold harmless Alpha Express Transport LLC from all claims, damages, losses, or expenses (including attorney fees) resulting from:
- Actions or negligence of the Client or guests;
- Property damage or personal injury during the rental;
- Any violation of laws or regulations.
4.4 Alcohol and Minors:
The Client is responsible for ensuring that no alcohol is served to minors. The Company reserves the right to refuse or terminate service if underage drinking or illegal activity is observed.
5.0 Additional Service Conditions
5.1 No Smoking or Vaping:
Smoking or vaping is strictly prohibited inside the vehicle.
5.2 Excessive Cleaning:
If the bus requires cleaning beyond normal use (e.g., spills, vomit, food mess), a minimum $250 cleaning fee will be an extra charge.
5.3 Mechanical Failure or Emergencies:
If a mechanical issue or unforeseen emergency prevents completion of service, the Company’s liability is limited to a refund of unused rental hours.
